Much of north Scottsdale is in the Environmentally Sensitive Lands overlay, where part of each lot is set aside as natural open space that can’t be built on. Some developments and the Foothills Overlay have their own standards, so the city suggests a setback request for your specific property.

Permits and HOA review in Scottsdale

Scottsdale doesn’t require a building permit for a detached, non-livable structure such as a pergola under 200 square feet, but it must meet setbacks and get plan approval from Planning Services at the One Stop Shop. Patio covers need a building permit, and electrical or plumbing run to any accessory structure needs a permit regardless of size. Accessory structures can’t sit in the front or side yard setbacks, can cover no more than 30% of the rear yard, and in most zoning districts must be at least 10 feet from the house. The Foothills Overlay has its own, stricter standards, and work done without a required permit is fined double the permit fee. Applications go through Scottsdale SPUR, the city’s permitting portal.

If your home is in an HOA, its architectural review is separate from the city permit, and you may need both before work starts.
